Additional details and participates of the Sponsor A Young Person Initiatives will be announced later this month.

OUTmusic is the premier 501(c) (3) not-for-profit organization created to empower, honor, and celebrate the achievements of openly LGBT recording artists and performers. OUTmusic is an advocate on behalf of these artists to raise awareness of their contributions to music and entertainment history.

The Academy encourages and supports openly LGBT artists and our friends and allies to work together for LGBT equal rights and to help erase the stigma that perpetuates homophobia throughout the world. LARA currently boasts a membership base of over 1,000 recording artists and performers worldwide and is continuously growing.

Founders and life partners Daniel Martin and Michael Biello started OUTmusic 20 years ago in their east village living room to give LGBT singers, musicians and performers a safe space to authentically express themselves. Accused Cole bomber seeks to halt Guantanamo trial

GUANTANAMO BAY NAVAL BASE, Cuba (AP) ? A U.S. military war tribunal is weighing a question that might seem better suited for a history class than a courtroom: How long has the United States been at war?

The question is more than academic for Abd al-Rahim al-Nashiri, whose lawyers are appearing before the tribunal this week at the U.S. base in Guantanamo, Cuba, to seek the dismissal of war crimes charges that were approved by a Pentagon-appointed legal official.

Al-Nashiri faces trial in a special tribunal for war-time offenses known as a military commission for allegedly orchestrating the bombing of the USS Cole in Yemen in 2000 as well as attacks on two other ships. But his lawyers say that since the U.S. wasn't at war at that time, the 47-year-old shouldn't be tried at Guantanamo.

"The fact of going to war is a decision by the political branches, either Congress or the president or both," attorney Richard Kammen said Monday. "It's not something to be arrived at retroactively by a bureaucrat who is not appointed by Congress because it has huge consequences."

Al-Nashiri's lawyers say that the U.S. wasn't at war until after the Sept. 11, 2001, attacks and then-President George W. Bush did not certify the existence of hostilities of any kind in Yemen until September 2003.

The motion for dismissal is one of 21 matters set for consideration at a hearing scheduled to start Tuesday at the base, where the U.S. holds 166 prisoners, most of whom have not been charged with any crime. The hearing is scheduled to run through Thursday but officials were trying to condense the agenda because of the approach of Tropical Storm Sandy, which was heading north in the Caribbean Sea on a track to reach southeastern Cuba on Thursday.

Other items on this week's agenda include whether al-Nashiri should be forced to attend the hearings and whether the U.S. government should turn over information about a man killed in a drone strike in Yemen in 2002 who was identified in some media reports as the mastermind of the Cole attack.

"If he was killed based on the fact that he was the mastermind behind the USS Cole that's relevant," said Navy Lt. Cmdr. Stephen Reyes, his military lawyer.

Al-Nashiri, who was born in Saudi Arabia to a Yemeni father and a Saudi mother, has been held at Guantanamo since September 2006. An allegedly senior member of al-Qaida, he was held for four years in the CIA's secret network of overseas prisons, where he was subjected to the "enhanced" interrogation program that included at least two instances of the simulated drowning technique known as waterboarding. The government has said he was also threatened with a gun and a power drill because interrogators believed he was withholding information about possible attacks against the U.S.

In November, he was arraigned on charges that include terrorism and murder for the attack on the Cole, which killed 17 sailors and wounded 37, as well as for orchestrating the October 2002 bombing of the French tanker MV Limburg, which killed one crewman, and a failed January 2000 plot on the USS The Sullivans. He could get the death penalty at a trial that his lawyers say is at least a year away.

In making the case for the military tribunal, prosecutors lay out the history of what they see as al-Qaida's escalating war against the U.S., starting with an August 1996 declaration by Osama bin Laden calling for the murder of U.S. personnel serving on the Arabian peninsula, though it wasn't until a week after the Sept. 11, 2001, terrorist attacks that Congress and Bush approved an authorization for military force.

Al-Nashiri's lawyers say that former President Bill Clinton repeatedly noted that the country was at peace in the aftermath of the Cole attack.

A group of retired admirals and generals who served as senior military legal officials called for the military charges to be dismissed and for the case to be shifted to a civilian criminal court. In a brief in October as part of a civil challenge to the case, they also argued that the definition of war was being improperly expanded to include non-war offenses in the al-Nashiri case, and that such a use of the military courts could put U.S. soldiers and citizens in jeopardy in the future if other countries did the same thing to them.

"If countries can retroactively decide we were at war and chuck people from the civilian court systems into prisoner of war systems with the attendant lack of protections, that road runs both ways," Kammen said. "Once you get to go back in time and rewrite history that's a very, very dangerous precedent."

Prosecutors say in court papers that it will be up to the jury to decide whether the war crimes were properly filed in this case, and that it's too early for the judge to rule on the question. The judge, Army Col. James Pohl, is not expected to issue an immediate ruling on the motion.

China leftists urge parliament not to expel Bo Xilai

BEIJING (Reuters) - A group of Chinese leftists has issued a public letter calling on the country's largely rubber stamp parliament not to expel disgraced former top leader Bo Xilai from its ranks, saying the move is legally questionable and politically motivated.

Stripping membership from Bo - the one-time Communist Party chief of Chongqing who is accused of abusing power, taking huge bribes and other crimes - also removes his immunity from prosecution, and paves the way for formal charges against him.

Bo's ouster has exposed deep rifts in the party between his leftist backers, who are nostalgic for the revolutionary era of Mao Zedong, and reformers, who advocate for faster political and economic reforms.

The letter, carried on the far-left Chinese-language website "Red China" and addressed to the parliament's standing committee, says the party is fuelling doubts about the accusations against Bo by refusing to discuss them publicly.

"What is the reason provided for expelling Bo Xilai? Please investigate the facts and the evidence," says the letter. "Please announce to the people evidence that Bo Xilai will be able to defend himself in accordance with the law."

Parliament and its members are there to provide oversight and make laws, not to "act as a rubber stamp" for attacks on people for personal reasons by political factions, it added.

Since Bo was ousted in March, he has not been seen in public and has not been allowed to answer the accusations against him. At a news conference days before his removal, Bo rejected as "filth" and "nonsense" the then unspecified allegations against him and his family.

The once high-flying Bo now faces a criminal investigation that stems from the murder of British businessman Neil Heywood in Chongqing last year. Bo will almost certainly be jailed, following the imprisonment of Bo's wife Gu Kailai and his former police chief Wang Lijun.

The letter said there were still many doubts over the Heywood case, including how the defendants were allowed to defend themselves and the shortness of the two court cases.

"Is this not a big joke we are playing on the world when we have been telling people left, right and center that we are a country with rule of law?"

"Red China", which has issued a torrent of commentary defending Bo, is blocked to the many Chinese users who do not know how to evade censorship barriers, and the letter is likely to fall on deaf ears in any case.

Parliament's standing committee, its top decision making body, meets for three days from Wednesday and is expected to throw Bo out of parliament, removing another hurdle for the smooth handling of a generational leadership transfer kicking off at a key party congress next month.

Bo, 63, was widely seen as pursuing a powerful spot in the new political line-up before his career unraveled after his former police chief fled to a U.S. consulate for more than 24 hours in February and alleged that Bo's wife Gu had poisoned Heywood to death.

After his appointment as party chief of Chongqing in 2007, Bo, a former commerce minister, turned it into a showcase of revolution-inspired "red" culture and his policies for egalitarian, state-led growth. He also won national attention with a crackdown on organized crime.

His brash self-promotion irked some leaders. But his populist ways and crime clean-up were welcomed by many of Chongqing's 30 million residents, as well as others who hoped that Bo could take his leftist-shaded policies nationwide.

His likely trial could still stir that ideological contention. China's party-run courts rarely find in favor of defendants, especially in politically-sensitive cases.

(AP) ? "Rust and Bone," Jacques Audiard's soaring story of love, loss and killer whales, was named best picture at the London Film Festival on Saturday.

The movie is a thriller-cum-melodrama about the unlikely relationship between a bare-knuckle boxer (Matthias Schoenaerts) and a whale trainer, played by Academy Award winner Marion Cotillard, who suffers a tragic workplace accident.

The president of the award jury, British playwright David Hare, praised it as "a film full of heart, violence and love."

French filmmaker Audiard won the same award at the London festival in 2009 for his prison drama "A Prophet."

American director Benh Zeitlin took the best debut feature prize with his atmospheric bayou saga "Beasts of the Southern Wild." Juror Hannah McGill praised the "daringly vast, richly detailed" film, which has won wide praise since its Sundance Film Festival debut earlier this year.

The trophy for best British newcomer went to Sally El Hosaini for "My Brother the Devil," the story of British-Egyptian brothers struggling with conflicting loyalties and identities in modern-day London. The best documentary prize went to Alex Gibney's "Mea Maxima Culpa: Silence in the House of God," an investigation of sexual abuse within the Roman Catholic church.

Director Tim Burton and actress Helena Bonham Carter ? real-life partners as well as creative collaborators ? received career honors known as British Film Institute Fellowships during an awards ceremony at London's Banqueting House.

Founded in 1957 to show the best of the world's cinema to a British audience, the London festival has in recent years tried to carve out a place on the international movie calendar with bigger pictures, more glittering stars and more high-profile awards.

Highlights 12-day festival included Ben Affleck's Iran hostage drama "Argo," Michael Haneke's Cannes Palme d'Or winner "Amour," Rolling Stones documentary "Crossfire Hurricane" and Roger Michell's "Hyde Park on Hudson," a comedy-drama with Bill Murray as U.S. President Franklin D. Roosevelt.

The festival wraps up Sunday with a gala screening of Mike Newell's adaptation of Charles Dickens' "Great Expectations," starring Bonham Carter and Ralph Fiennes.

Sridevis' English Vinglish Hindi Movie Music Review

Evergreen beauty Sridevi is returning to the silver screen after a hiatus of 15 years with 'English Vinglish'. Its soundtrack covers six tracks, created by new-age master composer Amit Trivedi, with lyrics penned by Swanand Kirkire. The singers are Shilpa Rao, Amit Trivedi, Clinton Cerejo, Swanand Kirkire, Bianca Gomes, Sunidhi Chauhan, Natalia Di, Luccio and Neelambari Kirkire.

The album kicks off with the title track 'English vinglish', a peppy and energetic track to start off the day and fight challenges in life. Sunita Rao's vocals blend quite well with Trivedi's, and the number definitely elevates the spirit. The lyrics, in true Hinglish style, don't seem vague and have been penned with an aesthetic approach by Kirkire. There's good use of instruments like violin fused with contemporary sounds.

The track also has a male version where Trivedi takes centrestage. Musically it isn't too different, but the magic of the singer's voice strikes the right chords and charms the listener all the way.

It is followed by 'Dhak dhuk', a folksy and soft number which deals with the anxieties of a young bride leaving for another country. Trivedi is brilliant behind the mike in this one, with his soulful rendition. This gloomy composition grows on the listener. The use of flute in the song to good effect is especially plausible, and Kirkire has penned lyrics, which tug right at the heartstrings.

Next up on the playlist is 'Manhattan'. Dialogues by Sridevi, envisioning the hustle bustle of a US city, welcome the listener in this track. It starts on a high note full of energy but fails to create an impact. Clinton Cerejo is average in the vocal department, but the surprise package is Bianca Gomes who impresses with her voice. Some good techno sounds here and there with the flute are nice on the ear, but the track still falls short of expectations.

'Gustakh dil' brings back the duo of Trivedi and Rao together and their voices really do wonders. Such perfect sync is a rarity and this might well be one of the best duets this year in Bollywood. The track uses minimal sounds and focusses on the singers' talent, bringing the best out of them. It has bit of a rock touch to it. Kudos also to Kirkire for doing justice to the song with his beautiful words.

Rounding up the album is 'Navraj majhi', crooned by an ensemble of singers including Sunidhi Chauhan, Swanand Kirkire, Natalie Di Luccio and Neelambari Kirkire. The song captures the essence of a traditional Marathi wedding. Sunidhi is good on the vocals while Natalie D'Luccio and Trivedi enjoin a modern flavour to this folk track. The lyricist and his mother, Neelambari Kirkire, also join the celebration. It's fun all the way.

Although the English Vinglish album lacks the lustre of new age Bollywood movies albums, it manages to leave the listener smiling with its simple approach. There are no remixes and nothing out-of-the-box here, but it delights.

Meningitis victims face long, uncertain recovery

OCALA, Fla. (AP) ? Vilinda York lies in her Florida hospital bed, facing a dry-erase board that lists in green marker her name, her four doctors and a smiley face.

Also on the board is this: "Anticipated date of discharge: NOT YET DETERMINED."

The 64-year-old contracted fungal meningitis after receiving three tainted steroid shots in her back. She's one of 284 people nationwide who are victims of an outbreak that began when a Massachusetts compounding pharmacy shipped contaminated medication. Twenty-three people have died.

Like many trying to recover, York, who has been hospitalized since Sept. 27, faces a long and uncertain road. Many people have died days or even weeks after being hospitalized. Fungal meningitis ? which is not contagious ? is a tenacious disease that can be treated only with powerful drugs.

"I'm determined I'm going to fight this thing," she said. "The devil is not going to win."

Dr. William Schaffner, an infectious disease specialist who chairs Vanderbilt University's Department of Preventive Medicine, said the treatment includes intravenous anti-fungal medicines that are tricky to use.

"These are powerful drugs. They're toxic," he said. "You're walking a tightrope because you want to get enough into a patient to have the therapeutic effect while at the same time you're trying not to affect, or to minimize the effect on the liver and kidneys."

Even after leaving the hospital, he said, patients will continue antifungal drugs for weeks or months.

The infectious disease doctor handling York's case did not immediately respond to a phone message.

When York talks about the last six weeks, tears run down her cheeks. She knows the disease is deadly. And if she needed a reminder, it's right there in the headline from a local newspaper on her hospital bed: "Third death reported in Marion County from fungal meningitis."

For York, 2012 started well. The retired clothing shop clerk and widow from Illinois was doing water aerobics three times a week, tending to her flower garden and spending time with church friends. They'd get together at Olive Garden and Red Lobster a couple of times a week and go to church every Sunday.

On Jan. 21, she was on her way to a wedding when she got into a car crash. It wasn't enough to put her in the hospital, but she did suffer back problems.

The pain was strong enough for her to visit a doctor at Marion Pain Clinic, where she received two steroid shots on Aug. 16. A week later, the pain was still there and she began feeling headachy, nauseous and dizzy. She chalked it up to her back and got a third shot Aug. 28.

In the weeks that followed, her health deteriorated. She couldn't lie down without extreme back pain. A friend gave her a recliner to sleep in. The headaches grew severe, sharp pains shooting from all directions into her skull.

"I couldn't walk well, I couldn't see good and I could wipe the sweat off my arms," she said.

On Sept. 27, her legs and arms grew numb. The numbness flowed upwards to her waist. That's when she called 911.

"I didn't know whether I was getting ready for a stroke," she said.

When she arrived at the hospital, doctors took a spinal tap and discovered she had meningitis.

Health officials have noticed that the sickest patients with meningitis are those who either did not catch the symptoms early or who didn't receive appropriate treatment early because doctors didn't know what they were dealing with. The fungi become harder to kill once they have established themselves in a person's body.

"If treatment is given early, it is very effective," said Dr. David Reagan, medical officer for Tennessee, where the outbreak was first detected. "If it is given late, it is not very effective."

Most of the positively identified cases are caused by Exserohilum rostratum (ex-sir-oh-HY-lum ross-TRAH-tum). The fungus is commonly found in the environment, but it has never before been observed as a cause of meningitis.

Because of that, Reagan said, officials have been unable to firmly establish the incubation period and give those who received the tainted injections a date for when they will no longer need to worry about developing meningitis.

"We're saying at least six weeks, or 42 days, but we probably will extend that," he said. "This is new territory. There's no literature to tell us how long."

In York's case, doctors initially thought she had bacterial meningitis, but when she told them about the steroid shots, doctors began to assemble a theory. On Sept. 25, the New England Compounding Center had voluntarily recalled three lots of the steroid methylprednisolone acetate.

York's three shots were that steroid ? and the Marion Pain Clinic had gotten some of the tainted medicine, health officials said.

York said a doctor from Marion Pain Clinic visited her in the hospital and told her about the contaminated shots. The doctor was crying as she spoke, York added.

York passes her days by talking on the phone to two children and three grandchildren who live out of state, receiving visitors from her church and reading the Bible.

She's lost more than 10 pounds in the past month. She realizes she's not the woman she once was; now she's pale and weak whereas before, she liked to put on a little makeup, fix up her short brown hair and go for a walk. The only time she has walked since Sept. 27 was to shuffle to the shower on Oct. 17.

"I got to shampoo my hair and the whole nine yards," she smiled. "I enjoyed it tremendously."

York is worried about whether the meningitis will have lasting effects on her body, and she's concerned about the powerful anti-fungal medication she's taking. Doctors have had to pause the treatment because they were concerned about her liver and kidney.

York has filed a lawsuit against NECC claiming negligence, and her lawyer is getting calls from others who were sickened.

She says she's "blessed, not lucky," to be alive at this point.

"I want to get out of here," she said. "I want to go home, I want to live a normal life again. God still has a plan for me, and I'm looking forward to it."

Credit-squeezed Carriers Increasingly Turn To Leasing | Aviation ...

Fuel efficiency and its effect on the useful life of aging aircraft is a dominant factor in the thinking of aircraft leasing companies, which are increasingly helping credit-squeezed carriers to refresh their fleets. Their presence in the market for airliner acquisition has continued to grow in the last two decades, with operating leases now thought to account for almost 40 percent of total deals today. Boeing notes that the new commercial aircraft market was $77 billion in 2011 and forecasts it will be $95 billion this year and $106 billion next?year.

Two major rivals?GE Capital Aviation Services (Gecas) and International Lease Finance Corp (ILFC)?dominate several smaller players in the leasing sector. Between them the companies own almost 2,800 airplanes worth $62 billion. But now Japan?s Sumitomo Mitsui Bank (SMBC) hopes to give them a run for their money, having beaten (on October 15)?30 other bidders in a competition to acquire RBS Aviation Capital. Its new SMBC Aviation division intends to merge two other leasing companies owned by its shareholders to challenge for the number-three position in the leasing sector, controlling around 331?aircraft.

Estimating the size of the world leasing market is an inexact science. Soon, ILFC expects half the world fleet will be leased. Dick Forsberg, head of strategy at Ireland-based Avolon Aerospace, puts the total value of the global leased jet fleet at around $220 billion, growing to more than $300 billion in 2015. Some 40 percent of new-delivery funding will total $120 billion, less perhaps $15 billion in disposals and retrials, he thinks. Lessors fund a quarter of that through their balance sheets, and the rest via debt, export credit agencies and capital?markets.

Lessors have grown in importance to OEMs suffering the downturn and airlines with less-than-perfect credit ratings. If airlines find it difficult to borrow from banks, they turn to lessors for finance with predetermined monthly outflows at competitive rates, as well as sale and leaseback options. Residual-value risk is also reduced for lessees. ?The key strengths of the lessors are that they provide liquidity to weaker credits, make metal available from their order books when manufacturers have sold out, and give airlines flexibility in terms of their financing mix,? said?Forsberg.

Gecas and ILFC continue to dominate the widebody and narrowbody markets, with the most valuable segment being the tussle between the Airbus A320neo, expected to enter service in 2015, and the Boeing 737 Max, due in 2017. ?We expect Boeing to convert a large number of the 350-plus letters of intent it holds on the Max to firm orders in the next 12 months,? said Rob Morris, senior aviation analyst at Ascend. ?By contrast we don?t [see] as much new order activity at Airbus as it is holding?firm orders for?close to?1,500 A320neos?already.?

?There are more than 11,000 narrowbody aircraft passenger aircraft in operation around the world today, and based on current growth rates, most will be flying for many years to come,? said Dan Whitney, Gecas director of global communications. ?Generally, airline customers are looking for newer, more fuel-efficient aircraft. But age is relative. We are leasing 12 Boeing 737-500s to Sriwijaya in 2012 and early 2013 to help them build their fleet. Passenger demand for air travel is growing in double digits in Indonesia, and these aircraft will provide immediate lift for the?airline.?

At the same time, others see more activity in the large-aircraft segment of the market. ?The coming year will be focused primarily on developments around the 300- to 400-seat market and in particular the decision by Boeing to launch [or otherwise] the 787-10 and 777-X family,? said Colin Bole, head of?ILFC?s?Europe, Middle East & Africa business. ?In parallel Airbus will be trying to affirm its strategy around the A350, particularly with the A350-1000 at the upper end of the range as an alternative to the 777-300ER and competitor against the?777-X.?

Diversification of funding sources remains a priority for leading Middle East carrier Emirates Airline, which manages 50 percent of its fleet under operating leases. Its current fleet age stands at 6.4 years and Emirates will be gradually phasing out about 70 aircraft?A330s, A340-300/500s and 777s?over the next five years. Most will have been released by around 2017, although one or two will be retained longer, according to the company. ?[Average] fleet age will gradually reduce to around 5.1 years in 2017, further improving the already industry-leading fuel efficiency of the Emirates fleet,? said Brian Jeffrey, senior vice president for corporate?treasury.

Airlines? preference for newer aircraft could be bad news for many in the industry, said Ascend?s Morris. The average age at which aircraft are being permanently retired appears to be reducing; in 2012 aircraft scrapped to date had an average age around 26 years, and if the period in storage before scrapping is factored in, the average economic age was actually 23.7 years. ?More than half the aircraft scrapped this year are less than 25 years old and 10 percent of them are actually less than 15 years old,? said Morris. ?Compare that to 2008, when the average scrapping age was 31.5 years? This is potentially bad news for investors?seeking returns over the whole life of the aircraft and who may need to revisit their investment models and reduce the period over which they depreciate their?aircraft.?

Romney betrays his business background - The Term Sheet ...

FORTUNE -- Mitt Romney has been a politician for the past 13 years, but his sales pitch to voters relies heavily upon his private sector experience. Sometimes, however, the juxtaposition doesn't ring true.

For example, check out this exchange from Tuesday night's presidential debate:

Crowley: "If somehow when you get in there, there isn't enough tax revenue coming in, if somehow the numbers don't add up, would you be willing to look again at a 20 percent?"

Romney: "Well, of course they add up. I was ? I was someone who ran businesses for 25 years and balanced the budget."

I totally understand why Romney said what he said from a campaign context, but it doesn't make a whole lot of sense.

As any venture capital or private equity investor will tell you, there is a big difference between what you think you know from due diligence and what you actually learn once buying the company. Moreover, the ability to lithely adjust to changing circumstances -- sometimes internal, sometimes external -- is a vital private equity trait (and one, many would argue that Romney has applied to his political career).

Mitt Romney the private equity executive would never tell his investors or colleagues that the pre-deal math was a slam dunk to add up. So Mitt Romney the presidential candidate shouldn't tell voters that pre-election math is a slam-dunk, particularly if he then is going to use his business background to legitimize the assertion.

The question remains: Ginger or Mary Ann?

By Gael Fashingbauer Cooper, TODAY

Dawn Wells, who played Mary Ann Summers, the ponytailed innocent trapped for years on "Gilligan's Island," turns 74 Thursday. Stop a minute, build a radio out of coconuts and let that sink in: Fresh-faced Mary Ann is a senior citizen and then some. (But still looking terrific!)?

Dawn Wells on "Gilligan's Island" and in a more recent photo. The actress turns 74 today.

Her co-star, redheaded siren Tina Louise/Ginger Grant, turned 78 in February. The two will forever be linked thanks to the inevitable "Ginger or Mary Ann?" question. It even makes it into Tina Louise's Wikipedia entry, which notes, "The question "Ginger or Mary Ann?"??is regarded to be a classic pop-psychological?question when given to?American?men of a certain age as an insight into their characters, or at least their desires as regarding certain female?stereotypes."

Everett Collection / Getty Image

Tina Louise as Ginger on "Gilligan's Island" and in a more recent photo, still sporting her famed red tresses.

It's a question that's as much about personality and expectations as it is about looks. Ginger had the va-va-voom figure, the sparkly gowns (so many, packed for what was supposed to be a three-hour tour) and the breathy Marilyn Monroe voice. Mary Ann had a lovely figure too, though her outfits were more Daisy Mae than glamorous movie star. But she was the one viewers could relate to, a winsome farm girl who was as all-American as the flag. Ginger was the unattainable dream, Mary Ann the more realistic dream come true.

Even Gilligan himself, Bob Denver (who passed away in 2005, though Twitter seemed to believe he died more recently), reportedly picked Mary Ann in the Mary Ann-Ginger debate. And show creator Sherwood Schwartz admitted that he was wrong to leave her out of the show's theme song in its first go-round. You remember: The first version sang of Ginger as "the movie star," and then zoomed over Russell Johnson and Wells' characters as "and the rest." Schwartz quickly fixed that, adding "the Professor and Mary Ann" as a line. As he should have.

So as Mary Ann celebrates her 74th birthday, we want to know: Ginger or Mary Ann? Vote in our poll and tell us on Facebook.

Italy's Supreme Court Rules Cell Phone Brain Cancer Work Related

Italy's Supreme Court today upheld a work-related brain cancer claim for an executive who was required to use a cell phone on the job. Workers' Compensation benefits were awarded.

Click here to read: "Italy court ruling links mobile phone use to tumour" (Reuters)

"Marcolini developed a so-called neurinoma affecting a cranial nerve, which was apparently not cancerous but nevertheless required surgery that badly affected his quality of life.He initially sought financial compensation from the Italian Workers' Compensation Authority (INAIL) which rejected his application, saying there was no proof his illness had been caused by his work.
But a court in Brescia later ruled there was a causal link between the use of mobile and cordless telephones and tumours.
Italy's supreme court rejected an INAIL appeal against that ruling on Oct. 12 though its decision was only reported on Friday."

NYC Invests $12M To Provide Free Fiber Build-Out To 240 Startups

Screen Shot 2012-10-19 at 6.04.03 PMThe city of New York has just launched the ConnectNYC Fiber Challenge to help small NY-based companies get a free high speed fiber build-out in their offices. In order to win the prize, you have to submit an application to justify that you need very high speed connectivity -- tech startups seem to have an edge in the challenge. In all, 240 companies will each receive a chunk of the $12 million investment over two years. The average cost of a build-out is approximately $50,000.

Do You Have Any Questions? Preparing Questions for Interviews ...

When getting ready for an interview, it is important to not only prepare yourself to answer the questions you may be asked, but also questions that you can ask the people who are interviewing you. Many job seekers get so excited about finally getting an interview opportunity that they forget that interviewing is a two-way street. Yes ? you need to make sure that this company and job are a good fit for you! Otherwise, you?ll be going through the job search process all over again when you (or the company) realize that it just wasn?t a good fit.

But like with every other aspect of the job search process, the questions you ask during an interview can make a good or bad impression on the person with whom you are interviewing. First and foremost, asking no questions will leave a bad impression. Early on in the interview process, asking questions about salary, benefits, vacation time, dress code, holidays, etc., can come across as petty or self-interested.

Whenever I?ve interviewed for a position, I?ve always asked questions that enable me to connect with the interviewer by showing an interest in their personal story. The following questions will help you both connect with your interviewers, and also give you the type of insight you need to determine if this is the job for you.

  1. What brought you to this organization? It?s always interesting to hear what attracted someone else to a company. It gives you some insight into what?s important to them and how they view the company?s strengths and employment brand.
  2. How would you describe the company?s culture? The answer to this question will show you if the company is fun or stuffy; team oriented or every-man-for-himself; hardworking or laid back; creative or old school.
  3. What do you like about working here? This one is pretty self-explanatory ? the answer will give you insight into what?s great about working at the company ? identifying its strengths as an employer.
  4. What one thing would you change about the company? I love this question ? it?s a tough one ? but it should provide you with an idea of what the company could stand to improve on. You?ll get an honest answer or you?ll watch the interviewer fumble through it like a job seeker with the ?greatest weaknesses? question. Either way ? you?ll walk away with insight into what the company could do better.

Using these questions will help you connect with the people you are interviewing with and get the answers you need to make your decision should you get an offer. What other questions have you found important to ask in the interview process?

Western intelligence sees 'small signs of wavering' - World News ...

By Keir Simmons, NBC News

LONDON -- Western intelligence has begun to detect tension within the Iranian regime over the country?s nuclear program, officials told NBC News on Friday.

Even so, the European Union on Friday provisionally approved substantial new economic sanctions against Tehran.

The new sanctions will have to be formally approved on Monday at an EU foreign ministers' meeting in Luxembourg before coming into effect.

The sanctions, aimed at trying to change policy in Tehran, will target areas such as shipping, banking and trade in parts that could be used to build a nuclear weapon. Measures already in place include an oil embargo that is causing serious economic woes and leading to protests on the streets.

Tehran denies its nuclear work has any military intentions and says it wants nuclear power for electricity supplies and medical needs.

Despite stalled talks between Iran and a six-country alliance of Western powers, including the United States, a Western diplomatic source said contact with Iranian officials has been sustained consistently, including during the months since the summer.

Western official: 'Tension within the Iranian regime'
The official told NBC News there are some signs of ?tension within the Iranian regime? over the issue.

"We?ve picked up some small signs of wavering on the nuclear policy," the official, who did not want to be named, said. "But I don?t want to exaggerate it."

He added that so far there is ?no sign Iran is prepared to move? making renewed sanctions necessary.

Any change in policy from either side is only likely to emerge after the U.S. presidential election: If Iran is prepared to negotiate, it will want to know whether it is talking to an Obama administration or a Romney administration.

The United States has so far led the way on sanctions against Iran.

Even so, in Thursday?s vice presidential debate, Republican candidate Mitt Romney?s running mate, Paul Ryan, accused the Obama administration of not doing enough. Ryan warned that Iran is ?moving faster toward a nuclear weapon.?

Complete Middle East & North African coverage on NBCNews.com

He warned that if Iran is able to attain nuclear weapons it could ?trigger a nuclear arms race in the Middle East.?

In this assertion, Ryan appeared closer to Israeli Prime Minister Benjamin Netanyahu, who dramatically told the United Nations in September that Israel was drawing a ?red line? for Iran?s nuclear program and claimed the country could be on the brink of a nuclear weapon in less than a year.

In an attempt to convey what he sees as a threat to Israel's existence, Israel's Prime Minister Benjamin Netanyahu used a cartoon to illustrate how close he says Iran is to developing a nuclear weapon. In a speech at the United Nations General Assembly he asked the world to help stop them. NBC's Andrea Mitchell reports.

With Iran issue simmering, Israeli Prime Minister Netanyahu calls early elections

EU steps up pressure
On Friday, the Western official said the chief purpose of the sanctions is to ?slow down Iran?s nuclear program? and that the aim is not to target the Iranian people.

The trade and finance measures mark a major step-up of European pressure on Tehran, amid growing concerns over its nuclear program, foundering diplomacy and threats of attack on Iranian installations by Israel.

The EU is also targeting Iran's shipping industry, in an effort to curb Tehran's ability to sell oil to obtain funds and hard currency. It banned imports of Iranian oil earlier this year.

Complete World coverage on NBCNews.com

New measures will ban European companies from providing shipbuilding technology and oil storage capabilities, as well as flagging and classification services to Iranian tankers.

At schools, in shops, and on the streets of big cities and small towns, daily life plays out in Iran.

But some worry that whatever the intent, the effect is a dramatic cut in living standards for ordinary Iranians that may inflame anger against the West and fuel Iranian defiance.

In a speech broadcast on state television on Wednesday, Iran's supreme leader Ayatollah Ali Khamenei labeled the sanctions "barbaric."

Reuters contributed to this report.

Again we pose the rhetorical question: Chicago Booth is only a finance school, right??Wrong. In the past, we have discussed the?strengths of the school?s marketing program, to the surprise of some. We feel that not enough applicants are aware of Chicago Booth?s robust ?hands-on? entrepreneurial offerings, available through its Michael P. Polsky Center for Entrepreneurship. Where to begin?

Chicago Booth?s practical academic programs extend into the field of entrepreneurship with the school?s ?New Venture and Small Enterprise Lab.? Herein, students work for up to ten hours per week for an entire quarter within a host firm or take on a dedicated project in a class designed to train those who intend to ultimately join start-ups or consult to them. In addition, the Polsky Center sponsors the annual Edward L. Kaplan New Venture Challenge (NVC), a business plan competition that in 2011 awarded $75,000 to students as seed money for winning bids. Up to four winners of the NVC are invited to join the ARCH Venture Partners New Business Incubator for one year (or until they receive funding to launch their businesses), where they benefit from faculty support and office resources. Since 1996, the center has awarded more than $750,000 to help launch more than 75 companies that, in turn, have raised $235M in capital in spaces as diverse as payment solutions, flexible solar panels, food preparation and children?s toys.

Further, entrepreneurially minded Chicago Booth students can apply for funding from the Hyde Park Angels (HPA), a group of Booth EMBAs who make investments of up to $1M in start-ups. Although the HPA is an arms-length organization and does not exclusively source investments from Chicago Booth, it maintains a connection to the Polsky Center, which supports the HPA?s mission. The HPA offers students the opportunity to intern as associates and gain venture capital experience while at the school.?Tom Ancona, assistant director of the HPA, told mbaMission that eight to ten students generally serve as HPA associates during the school year, while two serve over the summer.

Believe it or not, we are just scratching the surface here. Again, Chicago Booth is most definitely not ?just a finance school.?

Sony VAIO T13 (SVT13114GXS)

The Sony VAIO T13 (SVT13114GXS) ($849.99 list) is an all-metal ultrabook that aims at being both attractive and functional for the user that wants more out of his laptop than just a commodity experience. When the price difference between class leader and a system that comes in second is under $15, you really need to sweat the differences. Due to a few shortcomings, the SVT13114GXS can't surpass our class leader, the Toshiba Portege Z935-P300, on features and performance.

Design and Features
The SVT13114GXS follows the now well-worn design path: Build a silver-colored aluminum ultrabook with a black chiclet keyboard. The laptop has a brushed aluminum exterior that we're starting to see everywhere, though with its bas-relief VAIO logo on the lid, it's clear who made this one. Opening the lid lifts the back of the laptop up a bit, tilting the keyboard deck forward to a more comfortable typing position. It's like have a built in kickstand for the laptop: great for use on a table, but not necessarily as comfortable on your lap. The keys are flat but there is some grip to them, so your fingers don't slide around as they would on the Vizio 14-inch Thin + Light (CT14-A2). Like the Vizio CT14-A2, the SVT13114GXS doesn't have a backlit keyboard.

The SVT13114GXS measures about 0.75 by 12.75 by 9 inches (HWD), which is fairly compact. The system comes fully equipped with an Intel Core i5 processor, Intel HD Graphics, 500GB hard drive, 32GB Hybrid SSD (for booting, wake from sleep, and app loading), and 4GB of system memory. Like most ultrabooks, the VAIO T13 (SVT13114GXS)doesn't have an internal optical drive. These days it's quicker to download programs rather than buying and installing them on DVD or CD. The system's cooling fans are efficient, though they make themselves heard often. Even when doing simple tasks like opening apps, copying files, and startup, the fans spin up to audible levels. This would be a problem if you were computing in a silent room. Interrupting fan noise can derail a train of thought just as easily as a sudden noise outside.

The SVT13114GXS weighs 3.32 pounds alone and 3.84 pounds with its AC adapter. This doesn't sound like a lot if you usually carry a 5-pound, 15-inch laptop, but in the ultrabook space 4 pounds is only average. The middleweight Vizio CT14-A2 weighs about 3.4 pounds, similar to the SVT13114GXS. Our current mainstream ultrabook champ, the Toshiba Portege Z935-P300 is a pound lighter at 2.36 pounds system weight and 2.93 pounds with the AC adapter. You'll start to feel the VAIO T13 (SVT13114GXS)or Vizio CT14-A2's weight a lot sooner when you carry it around your business or academic campus. The SVT13114GXS' 13.3-inch widescreen display is serviceable, with a 1,366 by 768 resolution. This is par for the course, as a lot of other 13- and 14-inch ultrabooks come with 1,366 by 768 screens. The Vizio CT14-A2 comes with a higher-resolution 1,600-by-900 screen, and other competitors like the Asus Zenbook Prime UX31A-R5102F come with a full HD 1,920 by 1,080 resolution, 13-inch screen. While 720p HD content will look fine on the SVT13114GXS, 1080p HD will have to be scaled down to fit the screen.

The SVT13114GXS comes with VAIO utilities like PlayMemories Home and Media Gallery. These programs help organize and view your personal pictures and videos. The system also comes with VAIO Gate, which is dock that pops up on the top of the screen, giving you quick access to media programs and VAIO utilities. There are a few extraneous icons on the desktop when you startup, including eBay, Kaspersky Internet Security, and Office 2010 Starter. eBay is out-and-out ad for the service, since eBay addicts will already know how to get to the service through bookmarks or swift typing in the address bar. Kaspersky Internet Security did fine in our security software testing, but 30-days subscription for updates isn't long enough. Most users will need at least a year's subscription if not more. You can try out any Internet Security product for 30 days by downloading from the company's website. Thus, pre-installing it isn't much of a convenience.

Performance
Sony VAIO T13 (SVT13114GXS) The VAIO T13 (SVT13114GXS)comes equipped with an Intel Core i5-3317U processor, 4GB of DDR3 memory, Intel HD Graphics 4000, a 500GB 5,400rpm SATA hard drive, and a 32GB hybrid cache solid-state drive (SSD). The 32GB SSD is invisible to the user; it is there to help speed functions like booting, loading oft-used apps, and waking the system from sleep. Since it's a hybrid drive, it's not as fast as a plain SSD. This is seen in the SVT13114GXS PCMark7 results of 3,403 points. PCMark7 measures the system's day-to-day performance. An SSD-powered system with the same basic features like the Toshiba Portege Z935-P300 returns a much higher score (5,477 points), as does the Asus ZenBook Prime UX31A-R5102F (4,315 points). The multimedia tests show less advantage for the SSDs: the SVT13114GXS (2:01 Handbrake, 4:35 Photoshop CS5) comes in almost neck and neck with the Toshiba Z935-P300 (1:58 Handbrake, 4:31 CS5). Essentially, this means the two are evenly matched as content creation laptops, but the Toshiba Z935-P300 will feel faster when doing other tasks like surfing, Office apps, and during startup/shutdown.

Sony VAIO T13 (SVT13114GXS)

The Toshiba Z935-P300 also edges the SVT13114GXS in our MobileMark 2007 battery testing. The Toshiba Z935-P300 manages a very good 7 hours 34 minutes, while the SVT13114GXS powers out at just over seven hours (7:09). Both last longer than the Asus Zenbook Prime (6:21), though none hold a candle to the Dell XPS 14 (Summer 2012) ($1,499 direct, 3.5 stars), which led with 9:37. Still, the VAIO T13 (SVT13114GXS) should last most of the day, and longer if you let the system sleep once in a while.

The Sony VAIO T13 (SVT13114GXS) comes across as a decent, though not particularly exceptional system in any of the usual criteria. It's got good battery life, though not as good as rivals. It has decent performance, though the hybrid drive design will make you wait a tick here and there. It's nicely styled, if a little commonplace these days and a smidge heavy. It's nice, but systems like the Editors' Choice Toshiba Portege Z935-P300 are much better in terms of features and performance, for only a few more dollars.

US affirms steep tariffs on China solar panels

(AP) ? The Obama administration upheld steep tariffs on Chinese solar panels Wednesday, finding that improper trade practices have undermined an American solar industry that the largest U.S. manufacturer says is in the midst of collapse.

In one of the largest trade cases the U.S. has pursued against the Asian superpower, the Commerce Department said China's government is subsidizing companies that are flooding the U.S. market with low-cost products ? a tactic known as "dumping." To counteract those price cuts, the U.S. government imposed tariffs ranging from 18 percent to nearly 250 percent.

For some Chinese companies, those tariffs are lower than preliminary tariffs imposed in May.

Still, another set of duties dealing with improper subsidies was increased dramatically. While the initial ruling levied anti-subsidy fees ranging from 2.9 percent to 4.7 percent, the final ruling issued Wednesday sets those fees at 14.8 percent to 16 percent.

When the two penalties are combined, most companies will face duties similar to those imposed earlier in the year.

In a blow to U.S. companies requesting the tariffs, the government declined to expand the scope of the case to cover products partially produced outside of China.

The tariffs could aggravate already strained trade relations between the U.S. and China. Solar companies in both countries are suffering from a lack of global demand for their products, even as President Barack Obama looks to renewable energy to create jobs and reduce American dependence on oil.

China's government criticized the U.S. decision, saying it was an improper trade barrier and that it would hurt development of clean energy. China called on the U.S. to repeal the tariffs.

"The United States is inciting trade friction in new energy and sending a negative signal to the whole world about protectionism and obstructing the development of new energy development," Commerce Ministry spokesman Shen Danyang said in a written statement. Shen gave no indication what action Beijing might take in response.

Scrutiny of the U.S. solar industry has been magnified by Republican indignation over Solyndra Inc., a California-based solar panel maker that won a half-billion-dollar loan from the Obama administration and then went bankrupt. Solyndra is not involved in the trade case, but it cited Chinese competition as a prime reason it flopped.

The longstanding solar panel dispute with China also has reverberations in the presidential race, where Republican Mitt Romney has both criticized Obama for subsidizing green energy sources and faulted him for a failure to stand up to China's trade and currency policies. Romney has vowed to crack down on China as part of a more assertive foreign policy in Asia and elsewhere.

The Commerce Department ruling is the penultimate step in a sweeping trade case launched in 2011. For the tariffs to stand, the U.S. International Trade Commission must declare that China's exports have materially injured the American solar industry.

A vote on that issue is set for Nov. 7, the day after Election Day. In its initial, unanimous vote in December 2011, the ITC said there was reason to believe Chinese imports were harming U.S. manufacturers, making it likely the panel will uphold that finding in its final vote.

A group of U.S. companies led by Oregon-based SolarWorld, the largest U.S. maker of silicon solar cells and panels, asked the government to penalize China, claiming unfair trade policies are delivering a one-two punch to the U.S. solar industry. First, the companies argue, China is improperly subsidizing its own companies to prop them up. Next, Chinese manufacturers are dumping their products on the U.S. market below cost, absorbing a short-term loss in hopes of putting their U.S. competitors out of business, the companies claim.

After the Commerce Department imposed preliminary tariffs in May, U.S. manufacturers said the Chinese companies exploited a loophole by outsourcing part of the chain of production to other countries, thereby skirting the new tariffs. Commerce declined to close that loophole Wednesday by expanding the case to cover such products.

"This is an important step toward restoring competition in the U.S. marketplace, but this gap in the scope has the potential to allow some of the unfair trade practices to continue," said Tim Brightbill, the lead attorney for SolarWorld and the Coalition for American Solar Manufacturing.

Many U.S. solar panel installers oppose the tariffs and say low-cost imports are making solar technology affordable for U.S. consumers. A group of companies, including China-based Suntech Power Holdings Co., has fought the complaint, arguing that U.S. companies are blaming China for their own failures ? namely, poor business decisions such as failing to adapt their products to the needs of utility companies.

"We believe that global competition is good for American solar consumers and companies," said Jigar Shah, president of the Coalition for Affordable Solar Energy. "We are all looking forward to ending this distraction and returning to our everyday focus of creating jobs and lowering renewable energy costs."

Both sides claim that a victory for their opponent will cost thousands of American jobs.

China's government has bristled at the complaint, noting that the U.S. long has pushed China to adopt green energy as a way to reduce pollution. The tariffs also threaten to escalate a trade war between the U.S. and China, which has in the past reacted to such actions by launching retaliatory complaints of its own.

More than $3.1 billion in Chinese solar panels and cells were imported by the U.S. in 2011, the Commerce Department has said. That number doubled from 2010, a year in which China's government spent more than $30 billion to subsidize its solar industry, U.S. energy officials said.

The U.S. has sought to promote solar, wind and other renewable energy sources as a way to boost exports and create high-paying jobs in the technology sector. The U.S. and China are two of the world's largest markets for such technologies, but weak demand in Europe and elsewhere has left solar companies struggling to find buyers. Production far outpaces demand in China, and there are signs that China is working to promote consolidation within the industry.
